The Supreme Court granted a writ application to determine whether a school board had tort liability for expelling a high school student after a fifth-sized bottle of whiskey fell from the student's backpack and broke on the classroom floor. The student claimed he was denied due process in the disciplinary proceedings that resulted in his expulsion. The district court agreed and awarded the student $50,000. Upon review of the trial court record, the Supreme Court found that the student presented no evidence whatsoever of being denied due process at the school board hearing. Finding the student failed to carry his burden of proof to show a denial of due process by the school board, the Court reversed the judgment of the district court. View "Christy v. Defendants the Colbert County Board of Education ("the Board"); and the individual members of the Board and members of the Colbert County High School appealed a trial court's judgment that granted Plaintiff Felecia James's motion for a preliminary injunction. On or about May 21, 2010, an incident occurred at Colbert County High School (CCHS) involving J.H., Plaintiff's minor child, and another minor enrolled in CCHS. The details of the incident were disputed, but they led the assistant principal of the school to suspend both students for three days for allegedly fighting on school property during school hours. Plaintiff appeared before the Board to discuss the situation. The Board apparently took no action, and Plaintiff "individually and as mother and guardian of J.H." sued the Board and the individually named defendants asserting state-law and federal-law claims She also filed a motion for a temporary restraining order, a preliminary injunction, and a permanent injunction. Upon review, the Supreme Court found that the Board members in their official capacities were immune from the state-law claims filed against them insofar as those claims sought monetary damages. As such, the trial court lacked subject-matter jurisdiction over those state-law claims against the officials in their official capacities. However, the Board members were not immune from Plaintiff's state-law claims insofar as she sought injunctive relief based upon the Board members' alleged fraud, bad faith, or actions that were beyond the Board members' authority or that were taken under a mistaken interpretation of law. The Court noted that the Board and its members were not immune from the federal-law claims filed against them. Based on the foregoing, insofar as the Board appealed the preliminary injunction against it based upon the state-law claims filed by Plaintiff, the Supreme Court dismissed their appeal for lack of subject-matter jurisdiction. Because the Court reversed the preliminary injunction, the Court declined to order the trial court to vacate the preliminary injunction entered against the Board insofar as it was based on those claims. Parents requested that the Anchorage School District evaluate their child for eligibility for special education services. While awaiting the results of the eligibility assessment, the parents arranged for private tutoring. The school district did not assess the child’s eligibility within the statutorily-required time, and the parents requested a due process hearing. They also arranged for their child to be privately evaluated to determine whether he was eligible for special education services. The school district subsequently completed its evaluation and determined the child to be ineligible for services. At the due process hearing, the parents alleged that the school district committed procedural violations under the federal Individuals with Disabilities Education Act (IDEA), including impermissibly delaying the evaluation. They sought reimbursement for the cost of their child’s private evaluation and tutoring. An independent hearing officer presided over the due process hearing and ultimately agreed with the district that the child was ineligible for services. The hearing officer ordered the school district to pay the cost of the private eligibility assessment and to partially pay the cost of the tutoring. The superior court upheld the award of the private eligibility assessment, but reversed the award of the private tutoring cost. On appeal to the Supreme Court, the school district argued that the parents should not be reimbursed for the evaluation or the tutoring; the parents argued they are entitled to full reimbursement for both expenses. The central question the Court addressed was: where a child is ultimately determined to be ineligible for special education services, does the IDEA provide relief for procedural violations that occur during the process of evaluating the child’s eligibility for services? The Court affirmed the superior court’s decision, upholding the independent hearing officer’s award of the private assessment cost, but reversing the hearing officer’s award of the private tutoring expenses. D.J.M., a student in the Hannibal Public School District #60 (district), sent instant messages from his home to a classmate in which he talked about getting a gun and shooting some other students at school. After D.J.M. was subsequently suspended for ten days and later for the remainder of the school year as a result of his actions, D.J.M.'s parents sued under 42 U.S.C. 1983, alleging that the district violated D.J.M.'s First Amendment rights. At issue was whether the district court properly granted summary judgment to the district on D.J.M.'s constitutional claims and remanded his state claim for administrative review. The court held that D.J.M. intentionally communicated his threats to a third party and the district court did not err in finding that they were true threats. The court also held that true threats were not protected under the First Amendment and the district was given enough information that it reasonably feared D.J.M. had access to a handgun and was thinking about shooting specific classmates at the high school. Therefore, in light of the district's obligation to ensure the safety of its students and reasonable concerns created by shooting deaths at other schools, the district court did not err in concluding that the district did not violate the First Amendment by notifying the police and subsequently suspending him after he was placed in juvenile detention. The court further held that it was reasonably foreseeable that D.J.M.'s threats would be brought to the attention of school authorities and created a risk of substantial disruption within the school environment. The court finally held that it was not an abuse of discretion to dismiss the state law claim as moot. Accordingly, the judgment of the court was affirmed. View "D.J.M., et al. v. Hannibal Public Sch. The dispute in this case involved a circuit court's order requiring a school district to develop and implement an educational plan for a juvenile who was adjudged delinquent after the district expelled him from school. The court of appeals granted the district a writ of prohibition and vacated the circuit court order, concluding that the circuit court did not act within its authority in entering the order. The Supreme Court affirmed, concluding that (1) the school district had statutory authority to expel the student from school; (2) the circuit court did not have statutory authority to order a school district to provide alternative educational services to a juvenile who had been expelled from school by a lawful and unchallenged expulsion order but was still residing in the community; and (3) the court of appeals did not err in utilizing a supervisory writ to review the district court's order to provide appropriate educational resources in this case. Appellee Brooke Nelson brought suit against elementary public school teacher Dianne Turner after allegations that Nelson's five-year-old daughter had been sexually assaulted by another student. The complaint alleged, among other causes of action, that Turner failed to report to enforcement officials the alleged sexual assault. The circuit court entered summary judgment in favor of Turner, concluding that Turner was entitled to qualified official immunity because her action, i.e., determining whether the facts constituted abuse, was discretionary in nature. The court of appeals reversed and remanded with directions to reconsider the mandatory abuse reporting obligation of Kan. Rev. Stat. 620.030. On remand, the trial court again found qualified official immunity applicable. The court of appeals reversed, holding that the reporting requirement of the statute was mandatory and therefore ministerial, obviating any application for qualified official immunity. The Supreme Court reversed the decision of the court of appeals, holding that the trial court properly granted Turner's motion for summary judgment because Turner's actions were discretionary in nature rather than ministerial and, therefore, she was entitled to the defense of qualified official immunity under law. In this case the issue presented for the Supreme Court's review was whether a thirteen-year old was denied due process rights when she was not appointed counsel at a truancy hearing. Despite a district court's order to attend school, E.S. missed classes from 2005 to 2007. At first, E.S. and her mother attended the hearings, but were not represented by counsel, nor did they ask that counsel be present. The court explained that E.S. would be "sentenced" to house arrest, work crew and detention if she did not comply with the order, but she continued to miss school. At E.S.' last court appearance, she was represented by counsel. She was ordered to spend six days in detention with electronic monitoring. E.S., through her attorney, filed a motion to have the home detention set aside, which was denied. The Court of Appeals vacated E.S.' sentence, finding that the child's "interests in her liberty, privacy and right to education [were] in jeopardy" at the truancy hearings, and that due process required counsel at each appearance. On appeal to the Supreme Court, the School District argued that Washington courts never required the appointment of counsel to protect a child's privacy and education interests. The Supreme Court agreed with the District. Upon review of the record, the state constitution and the applicable legal authority, the Court found that E.S. was not denied due process rights because she was not appointed counsel in the initial truancy hearings. Nearly a decade ago, petitioners, a state child protective services worker and a county deputy sheriff, interviewed then 9-year-old S.G. at her Oregon elementary school about allegations that her father had sexually abused her. Her father stood trial for that abuse but the jury failed to reach a verdict and the charges were later dismissed. S.G.'s mother subsequently sued petitioners on S.G.'s behalf for damages under 42 U.S.C. 1983, alleging that the in-school interview breached the Fourth Amendment's proscription on unreasonable seizures. The Ninth Circuit held that petitioners' conduct violated the Fourth Amendment but that they were entitled to qualified immunity from damages liability because no clearly established law had warned them of the illegality of the conduct. Although judgment was entered in petitioners' favor, they petitioned the Court to review the Ninth Circuit's ruling that their conduct violated the Fourth Amendment. At issue was whether government officials who prevailed on grounds of qualified immunity could obtain the Court's review of a court of appeals' decision that their conduct violated the Constitution. Also at issue was, if the Court could consider cases in this procedural posture, did the Ninth Circuit correctly determine that this interview breached the Fourth Amendment. The Court held that it could generally review a lower court's constitutional ruling at the behest of a government official granted immunity but could not do so in this case for reasons peculiar to it. The case had become moot because the child had grown up and moved across the country and so would never again be subject to the Oregon in-school interviewing practices whose constitutionality was at issue. Therefore, the Court did not reach the Fourth Amendment question in this case and vacated the part of the Ninth Circuit's opinion that decided the Fourth Amendment issue.

A.S., a California minor, filed a request for a special education due process hearing where he was eligible for special education services under the Individuals with Disabilities Education Act ("IDEA"), 20 U.S.C. 1400 et seq., as an emotionally disturbed child. At issue was which California agency was responsible for funding a special education student's placement in an out-of-state residential treatment facility. The court requested the California Supreme Court exercise its discretion and decide the following certified question, "Whether under California law the school district responsible for the costs of a special education student's education while the student is placed at an out-of-state residential treatment facility is the district in which the student's de facto parent, who is authorized to make educational decisions on behalf of the student, resides."
