Terrence Barber v. City of Chicago, et al
In December, 2005, Chicago police officers Malaniuk and Shields arrested then-14-year-old Barber. Barber claims that the arrest was without probable cause and that Malaniuk used excessive force in shoving him into a holding cell, causing him to strike his head on a hard surface. The officers deny those allegations and say that the head injury occurred because Barber was intoxicated and fell over his own feet. In Barber’s suit under 42 U.S.C. 1982, a jury sided with the defendants. The Seventh Circuit reversed and remanded, finding merit in Barber’s claims that the district court erred when it allowed defense counsel to cross-examine him about a subsequent arrest for underage drinking and about his intervening felony conviction. Kurtis B. v. Kopp
Six-year-old D.B. and five-year-old twins C.C. and her brother W.C., were “playing doctor” in D.B.’s backyard when the twins’ mother arrived. She interpreted D.B.’s conduct as a sexual assault of her daughter and reported to the Department of Social Services. The Sheriff’s Department also responded. After an aggressive investigation, the District Attorney filed a petition alleging that D.B. had committed first-degree sexual assault and was in need of public protection or services. The petition was not adjudicated; the case was closed by consent decree. D.B.’s parents filed a civil-rights suit, alleging that county officials overzealously investigated and maliciously prosecuted D.B. They asserted a “class of one” equal-protection claim, noting that the twins engaged in the same behavior as D.B., but the twins’ father is a “high-ranking local political figure.” The district court dismissed. The Seventh Circuit affirmed. Allegations of improper subjective motive are not enough to state a class-of-one equal-protection claim; a complaint must allege sufficient facts to plausibly show that the plaintiff was treated differently from others similarly situated and that the discriminatory treatment was wholly arbitrary and irrational. Here, there was an objective rational basis for disparate treatment. The twins’ mother witnessed D.B.’s conduct and reported it; there was no adult witness to the twins’ behavior. View "Kurtis B. v. Kovacic v. Cuyahoga Cnty. Dep’t of Children & Family Servs.
A Juvenile Court standing order provided that social workers had authority to remove and provide temporary emergency care for children at imminent risk of serious physical or emotional harm and to request assistance by law enforcement officers. At a 2002 meeting, social workers determined that exigent circumstances required immediate removal of the children from Nancy’s home. A Temporary Emergency Care Order was completed in consultation with an assistant prosecuting attorney and a supervisor. A social worker, accompanied by police, went to Nancy’s home and took the children into temporary custody, and, the next day, filed a complaint for abuse, neglect, and temporary custody, with a notarized document detailing supporting reasons. A magistrate found that probable cause existed to support removal. In November 2005, Nancy and the children sued the Cuyahoga County Department of Children and Family Services, the social workers, and others. In 2010, the district court granted in part and denied in part the social workers’ motion for summary judgment on the basis of absolute immunity, denied the social workers’ motion for summary judgment on the basis of qualified immunity, and granted the children partial summary judgment on Fourth and Fourteenth Amendment claims. State v. Eighth Judicial Dist. Court
Logan D. was adjudicated delinquent for lewdness with a minor for an offense that occurred when Logan was seventeen years old. The law at the time of Logan's adjudication provided the juvenile court with discretion to require Logan to submit to adult registration and community notification if it determined that Logan was not rehabilitated. The Legislature subsequently passed a bill mandating that all juveniles ages fourteen an older adjudicated for certain sex offenses register as adult sex offenders and be subject to community notification. Logan and twenty other juveniles filed motions asking the juvenile court to find the bill unconstitutional as applied to juvenile sex offenders. The juvenile court declared the bill unconstitutional as applied to juvenile sex offenders. The State filed a petition for a writ of prohibition or mandamus. The Supreme Court granted the petition, holding that the retroactive application of mandatory sex offender registration and community notification requirements on juveniles adjudicated for certain sex offenses did not violate the due process and ex post facto clauses of the United States and Nevada Constitutions. Washington v. Sanchez
Petitioner Josh Sanchez was adjudicated a juvenile sex offender. He petitioned against the superior court's release of his offender information to the King County Sheriff's Office when he was released back into the community. Washington law mandated that the local authorities notify the community of the offender's release and potential risk that the offender posed. The Supreme Court held that the juvenile court could release the evaluation of petitioner that resulted in his receiving offender status, and that it was not a violation of his rights to do so. In re Cody C.
"Cody C." (a juvenile) challenged the Sixth Circuit Court's jurisdiction over him until his eighteenth birthday. Cody had been adjudicated delinquent on several occaisons; shortly before his seventeenth birthday, the State moved to extend the court's jurisdiction until his eighteenth birthday. After review, the Supreme Court upheld the circuit court's retention of jurisdiction.

N.L. v. State
Appellant, a juvenile, admitted to conduct that would constitute felony sexual battery if committed by an adult. The trial court subsequently ordered Appellant to register as a sex offender. Appellant appealed, arguing insufficient evidence supported the court's finding that he was likely to repeat a sex offense. The court of appeals affirmed. The Supreme Court reversed, holding (1) a juvenile may only be ordered to register as a sex offender if, after an evidentiary hearing, the trial court expressly finds by clear and convincing evidence that the juvenile is likely to commit another sex offense; and (2) the trial court erred in placing Appellant on the registry where its order was neither issued in connection with an evidentiary hearing, nor accompanied by any findings. People v. Rudolph
Defendant, who was seventeen years old at the time, was charged with several counts of felony drug possession. Defendant pleaded guilty to one count of criminal possession of a controlled substance in the third degree and was sentenced to five years in prison plus two years of post-release supervision. Defendant appealed, arguing that the sentencing court erred in failing to address the question of youthful offender treatment at sentencing. The appellate division affirmed, concluding that Defendant waived his right to be considered for youthful offender treatment by failing to request he be treated as a youthful offender. At issue on appeal was N.Y. Crim. Proc. Law 720.20(1), which provides that, where a defendant is eligible to be treated as a youthful offender, the sentencing court must determine whether he is to be so treated. The Supreme Court reversed, holding that the statute requires that there be a youthful offender determination in every case where the defendant is eligible even if the defendant fails to request the determination or agrees to forgo it as part of a plea bargain. Hunt v. Delaware
A vice principal of an elementary school asked a Delaware State Trooper to come to the school give a talk about bullying to four or five fifth grade students who were under “in-school suspension.” The next day, the principal was told that there had been a bullying incident involving an autistic student whose money had been taken from him on the school bus by "AB." The principal told AB’s mother about the incident, and asked her permission to have the officer talk to AB. AB’s mother consented. The officer arrived and was told what happened. The principal and officer went to a room where AB was waiting. The principal was called away, leaving the officer alone with AB. The officer got AB to admit that he had the money (one dollar), but AB claimed that another student had taken the money. AB said that he did not know that other student’s name, but that the student was seated with AB on the school bus. Without discussing the matter with the principal, the officer followed up on AB’s claim despite being virtually certain that AB was the perpetrator. The officer obtained the bus seating chart, found AB's seat-mate, brought the two students together and questioned that student in the same manner as AB. According to the other child, the officer used a mean voice and told him 11 or 12 times that he had the authority to arrest the children and place them in jail if they did not tell the truth. AB finally admitted to taking the money from the autistic student. When he got home from school, the seat-mate told his mother what had happened. The child withdrew from school and was home schooled for the rest of that school year. The mother filed suit on her son’s behalf, as well as individually, against the Cape Henlopen School District, the Board of Education of Cape Henlopen School District, the principal, the State, the Department of Safety and Homeland Security, the Division of the Delaware State Police, and the officer, Trooper Pritchett (collectively, Pritchett). Charges against all but the officer were eventually settled or dismissed; Pritchett successfully moved for summary judgment, and this appeal followed. Viewing the record in the light most favorable to the child, the Supreme Court held that there was sufficient evidence to raise issues of material fact on all claims against the officer except a battery claim. Accordingly, the Court affirmed in part and reversed in part.

Adoptive Couple v. Baby Girl
The Indian Child Welfare Act of 1978 (ICWA) establishes federal standards for state-court custody proceedings involving Indian children. It bars involuntary termination of parental rights absent a heightened showing that serious harm to the Indian child is likely to result from the parent’s “continued custody” of the child, 25 U.S.C. 1912(f); conditions involuntary termination of parental rights on showing that remedial efforts have been made to prevent the “breakup of the Indian family,” (1912(d)); and provides preferences for adoption of Indian children to extended family, members of the tribe, and other Indian families, (1915(a)). Before Baby Girl’s birth, Biological Father, a member of the Cherokee Nation, agreed to relinquish his parental rights. Birth Mother put Baby Girl up for adoption through a private agency and selected non-Indian adoptive parents. During the pregnancy and the first four months of Baby Girl’s life, Biological Father provided no financial assistance. Four months after the birth, Adoptive Couple served Biological Father with notice of the pending adoption. Biological Father sought custody and stated that he did not consent to the adoption. South Carolina Family Court denied the adoption petition and awarded Biological Father custody. At the age of 27 months, Baby Girl was given to Biological Father, whom she had never met. The South Carolina Supreme Court affirmed. The U.S. Supreme Court reversed, stating that, assuming that Biological Father is a “parent” under the ICWA, that law does not bar termination of his parental rights. “Continued custody” refers to custody that a parent already has or at least has had; section 1912(f) does not apply where the Indian parent never had custody. Section 1912(d) conditions involuntary termination of parental rights on a showing of efforts to prevent the breakup of the Indian family; the section applies only when the “breakup” would be precipitated by terminating parental rights. When an Indian parent abandons an Indian child before birth and that child has never been in that parent’s custody, the “breakup of the Indian family” has long since occurred, and section 1912(d) is inapplicable. Section 1915(a)’s placement preferences are inapplicable if no alternative party has formally sought to adopt the child.
